Personal Information That We Collect

When we refer to “Personal Information” or “PII” in this Privacy Policy, we are referring to information that may identify you, and we use these terms to include Personal Data as defined by the European Union’s General Data Protection Regulation (“EU GDPR”), the United Kingdom’s General Data Protection Regulation (“UK GDPR” and together with the EU GDPR, the “GDPR”), Personal Information as defined by the California Consumer Privacy Act of 2018, as amended (“CCPA”), and other similar terms as defined applicable data privacy and security laws.

Information that you provide to us

We collect information that you provide to us. We may collect this information when you sign up to receive email or text messages, fill out a form, send us an email, communicate with us via social media, or request information. We also collect information about you when you make a donation or otherwise participate in our programming. The information we collect may include information that may identify you, such as (but not limited to) your name, email address, physical address, phone number, birthday, payment information, or other information that you may choose to provide to us.

Information that we collect automatically

We also automatically collect certain information when you visit the Site. For instance, we log information about your visit to the Site, including the browser that you use, access times, pages viewed, your IP address, and the page that you visited before coming to the Site. As used in our Site, the Twitter Pixel tool uses cookies to set a unique ID for users that allows third-party advertisers to target users with relevant advertisements. Information that we collect from other sources

We may also obtain information from other sources and combine that with information we collect through the Site or through other interactions with you. For example, if you create or log into your account through a social media site, we will have access to certain information from that site, such as your name, account information and friends lists, in accordance with the authorization procedures determined by the social media site. We also may collect information from data aggregators, who can assist with updating contact information or giving profiles, or review publicly available information (e.g., web and social media). We generally use such data to more effectively identify or connect with current and potential audiences and supporters.

By using the Site, creating an account, or providing us with Personal Information you are giving us your consent to collecting and using your Personal Information for all of the purposes described in this Policy.

How Do We Use Your Personal Information?

Text Message and SMS Marketing

If you choose, you can provide your mobile phone number to receive text message updates from us. You agree, that by providing your mobile phone number, you expressly consent to receive automated text and SMS messages from us to the mobile phone number that you provide. We may send you these messages from time to time, on a recurring basis, as events, announcements, and other information becomes available. Opting-in or providing your consent to receive these messages is not required in order for you to use the Site.

We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on your mobile carrier, it may not be possible to transmit the text message to you successfully, for instance, and some of our content may not be available on all carriers. Data Retention

We will keep your Personal Information only for as long as necessary to provide you with the Services, maintain our legitimate business operations, and/or exercise, defend or establish our rights. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. Disclosing Your Personal Infomation

We will not share your Personal Information except as described in this Policy. Note that we may de-identify Personal Information so that it is non-personal, such as by aggregating it or converting it to a code, sometimes using a function known as a "hash." We will treat de-identified information as non-personal to the fullest extent permitted by applicable law. We may share your Personal Information with third parties to help us use your Personal Information, as described above. Please note that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us.

Third-Party Websites

The Site may contain links to third-party websites. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms, and another entity may collect Personal Information from you. We do not control, review, or have any responsibility for the third-party websites, their content or their use of any Personal Information they may collect from you. Any links to third-party websites or locations are for your convenience and do not signify our endorsement of such third-parties or their products, content, or websites.

Do Not Track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Your Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information that you provide to us and that we collect. We have created mechanisms to provide you with the following control over your information:

We may need to delete your user account if you request that we delete some particular Personal Information. We may not accommodate a request to change or delete Personal information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your Rights

You have the following rights with respect to our practices regarding your Personal Information:

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls and will be encrypted using SSL technology.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to THE Site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures. In the event that any information under our custody and control is compromised as a result of a breach of security, we will take steps to investigate and remediate the situation and, in accordance with applicable laws and regulations, notify those individuals whose information may have been compromised.

Additional Information For And Rights Of Individuals Protected By The Gdpr

Under the GDPR, TLDF is a data controller. If you are a resident of the European Economic Area, United Kingdom, or Switzerland, the GDPR applies to your Personal Information, are a “Data Subject” and the following (in addition to those available under the Rights of TLDF Users Section) applies to our processing of your Personal Information.

  • Our Legal bases for Processing your Personal Information. If you are a Data Subject we will use and process your Personal Information under the following legal bases:
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to perform a contract we have, or are about to, entered into with you. For example, any Terms of Service entered into between us and you.
  • Where we need to comply with a legal obligation.
  • Where we have obtained your consent to process your Personal Information, which may be revoked at any time.
  • Additional Rights and Information for Data Subjects under the GDPR.
  • The right to restrict processing . This is the right to ask for a temporary halt to processing of your Personal Information, such as in the case where a dispute or legal case has to be concluded, or the data is being corrected.
  • The right to object. This is the right to object to further processing your Personal Information if such processing is inconsistent with the primary purposes for which it was collected.
  • Rights in relation to automated decision making and profiling. This is the right to not be subject to a decision based solely on automated processing. The Service does not engage in automated decision making and profiling.
  • Judicial Remedy. Notwithstanding anything to the contrary in this Privacy Policy, if you feel that we or one of our processors, if any, have infringed your rights under the GDPR, or that we are otherwise not in compliance with the GDPR with respect to your Personal Information, you may bring a legal proceeding against us in a court, or file a complaint with a supervisory authority, located in the EEA country where you regularly reside.
  • In the event that we share, or otherwise transfer, Personal Information covered by the GDPR and this Privacy Policy to a third party, or a country outside the EEA which does not have an adequacy decision from the European Commission (a “third country”), we will only do so if: (x) that third party, except in cases of government or law enforcement agencies, gives us contractual assurances that it will comply with the GDPR; and (y) to the extent necessary, have in place a GDPR compliant procedure in place to protect the transfer, e.g. EU standard contractual clauses, available here, and/or the United Kingdom’s International Data Transfer Agreement or Addendum, as applicable, available here, including any necessary assessments of the applicable third country, and supplemental measures designed to ensure you have essentially equivalent rights and remedies as you would in the EEA. Notice to California Residents

Additional Rights and Information for California Consumers. The CCPA applies to our practices with respect to Personal Information of California residents (“Consumers”). In addition to the rights described in Rights of TLDF Users Section above, under the CCPA, Consumers have certain rights regarding their Personal Information.

  • Additional Information Regarding Your Right to Access (Collect). Pursuant to the Right of Access in the Rights of TLDF Users Section, you have the right to request that we disclose Personal Information we have collected about them in the previous 12 months including, but not limited to, the categories of information collected by us, the specific pieces of information collected, the source(s) of such information by category, and the business purpose for collecting such information. This right may not be exercised more than twice in a 12-month period. In the previous 12 months, we have collected the following categories of Personal Information about consumers;
    • Identifiers. Identifiers can be your name, mailing address, email address, phone number, unique personal identifiers (device identifier, IP Address, cookies, beacons, pixel tags, mobile ad identifiers), account names, and similar information; We collect the identifiers from the consumers themselves, third parties, and automatic means;
    • Records Law Personal Information. Personal Information Under the California Customer Records Law (Cal. Civ. Code §1798.80) (“CCRLPI”);
    • Internet/Network Activity. Internet Activity Information includes browsing history, cookies, search history and a consumer’s interaction with a website;
    • Employment Information. Employment Information includes employment history; and
    • Inferences. Inferences drawn from any other category of personal information.

Except for sensitive personal information, we collect Personal Information in the above categories from the consumers themselves and by automatic means for the business purposes described elsewhere in this policy, and as required to comply with applicable law. We only collect sensitive personal information from consumers who are employees of, or who are applying for employment with, TLDF and the Personal Information of a person those employees/candidates designate as their emergency contact. Such sensitive personal information is only used in relation to their application for employment and/or for administering their employment and benefits if hired.

  • Right to Access (Sale/Share). As a Consumer, you also have the right to request that we tell you which of your Personal Information we have disclosed for a business purpose, sold, and/or shared in the previous 12 months. With respect to Personal Information being disclosed for a business purpose, the consumer shall receive the categories of information disclosed, sold, or shared and the types of entities, and the specific pieces of information, such information has been disclosed or sold to, or with whom they are shared. This right may not be exercised more than twice in a 12-month period. For Personal Information being sold or shared, if any, this includes the categories of information being sold or shared and the categories of third parties to whom it is being sold, or with whom it is being shared. In the past 12 months, we have disclosed personal information falling under the following categories of Personal Information:
    • Identifiers;
    • CCRLPI; and
    • Employment Information.

Except as to sensitive personal information, we disclose Personal Information in the preceding categories to the consumers themselves, to other users/third parties as the consumer may direct, service providers, third parties, and government/law enforcement agencies for the purpose it was provided/provision of services, to comply with applicable law, and as otherwise described above in the How Do We Use Your Personal Information Section. We only disclose sensitive personal information to external service providers in relation to a consumer’s application for employment and/or for administering their employment and benefits, if hired, and to relevant government authorities and law enforcement as necessary to comply with applicable law.

IN THE PAST 12 MONTHS WE HAVE NOT SOLD, AND DURING THE PERIOD OF TIME WHICH THIS PRIVACY POLICY IS POSTED WE SHALL NOT SELL, THE PERSONAL INFORMATION OF ANY CONSUMER, INCLUDING MINORS UNDER THE AGE OF 16.

  • Right to Limit the Use and Disclosure of Sensitive Personal Information. Consumers may, at any time, request that we cease using or disclosing any sensitive personal information that we have collected about them to only such uses or disclosures which are permitted by the CCPA.

  • Right to Opt-Out of Sale or Sharing of Your Personal Information. Consumers also have the right to opt-out of the “sale” or sharing of your personal information to third parties, including when we do so for cross-context behavioral advertising. While we do not sell your Personal Information for money, but we may share your information to a third party that provides us with services, such as helping us with advertising, data analysis, and security, which may technically fall under the definition of “for other valuable consideration,” which may be considered a “sale” under the broad terms of the CCPA.

You can request that all or a portion of your personal information in our possession or control not be “sold” or “shared” by clicking the “Do Not Sell or Share My Personal Information” link], and following the instructions to submit your request.

  • Right to Opt-In Following Prior Opt-Out. If you are a Consumer under the age of 16, or have previously elected to opt-out of the sale (as defined in the CCPA) or sharing of your personal information, you may elect to opt in, or back in, as applicable. The opt-in process will require a two-step verification to confirm your election, and will be governed by the disclosures, policies, and procedures described here, in our Privacy Policy, and our Terms.   • How do you exercise your rights under the CCPA? Because we offer our services exclusively online, you may submit your requests to exercise your rights under the CCPA by emailing us at info@77x.world, please include “Request for Privacy Information” in the subject line. We will acknowledge receipt of your request within 10 business days of receiving it, and will do our very best to respond within 45 calendar days of receipt of your request, and in no event will our response come more than 90 days after receiving your request. If we are unable to provide our response within the first 45-day window, we shall notify you as soon as we become aware of the possible delay and provide an explanation of why additional time is needed to respond.

Before we respond to any CCPA based requests relating to your personal information, we will take steps to reasonably verify the identity of the person making the request (“Requestor”) to make sure it’s you, or your authorized agent. We do this to this avoid disclosing your information to third parties and bad actors, not to inconvenience you in any way. If the identity of the Requestor cannot be reasonably verified, either as the consumer or their agent, then in order to protect that consumer, we shall not disclose the personal information requested.

Notice to Nevada Residents

If you are a Nevada resident, we do not “sell” your “covered information” as such terms are defined in the Nevada Privacy of Information Collected on the Internet from Consumers Act as amended by Nevada Senate Bill 220 (“Nevada Privacy Law” or “NPL”). Nonetheless, you may submit a request to prohibit such sales by contacting us at info@77x.world . As someone that is subject to the NPL, under your Right of Access described in the Rights of TLDF Users Section, you are entitled to additional information about the covered information of yours that we have or process. Please note that defined terms may vary among different state laws, and that the NPL definitions of certain terms apply to this Section, and your reading of Part A of the CCPA Section in reference to this Section. Notice to Virginia Residents

If you are a Virginia resident, this section and the Virginia Consumer Data Protection Act (the “VaCDPA”) also apply to you.

  • As someone that is subject to the VaCDPA, under your Right of Access described in the Rights of TLDF Users Section, you are entitled to additional information about the Personal Information of yours that we have or process. For this information, please see Part A of the CCPA Section above, specifically the subsections on the Right of Access and what categories are collected, sold, and disclosed. Please note that defined terms may vary among different state laws, and that the VaCDPA definitions of certain terms apply to this Section, and your reading of Part A of the CCPA Section in reference to this Section.
  • Additional Rights for Virginia Residents. In addition to the rights described in the Rights of TLDF Users Section above, under the VaCDPA, Consumers have the following rights:
  • The Right to Opt-Out of Sales of Your Personal Information. We do not sell your Personal Information (the VaCDPA defines this as “for money”), but if we did, you would have the right to opt-out of such sales at any time.
  • The Right to Opt-In to the Use of Your Sensitive Data. TLDF will not process your sensitive data without first obtaining your consent to do so.
  • The Right to Opt-Out of Profiling. You may opt-out of ‘profiling’, which the VaCDPA defines as using solely automated processing of personal data to make decisions that produce legal or similarly significant effects concerning a consumer. TLDF does not engage in profiling as the VaCDPA defines it.
  • The Right to Opt-Out of Targeted Advertising. As a Virginia consumer, you may also be able to opt-out of targeted advertising based on your activity on non-affiliated websites and services. Please be aware, if you do exercise this right, you may still see generic ads on the Site and targeted ads based on your activity with TLDF.
  • Right to Appeal Denial. In the event we deny your request to exercise rights under the VaCDPA, you will be notified of the basis for such denial, and will have the right to appeal such denial by emailing us at info@77x.world with “VaCDPA Appeal” in the subject line. In the event your appeal is denied, you have the right to contact the Virginia Attorney General’s Office to submit a complaint at https://www.oag.state.va.us/consumer-protection/index.php/file-a-complaint.

Notice To Connecticut Residents

If you are a Connecticut resident, this section and the Connecticut Data Privacy Act (the “CTDPA”) also apply to you.
